Canadian Court Limits Detention in Terror Cases (Canadian liberalism alert)

OTTAWA, Feb. 23 — Canada’s highest court on Friday unanimously struck down a law that allows the Canadian government to detain foreign-born terrorism suspects indefinitely using secret evidence and without charges while their deportations are being reviewed.

The detention measure, the security certificate system, has been described by government lawyers as an important tool for combating international terrorism and maintaining Canada’s domestic security. Six men are now under threat of deportation without an open hearing under the certificates.

“The overarching principle of fundamental justice that applies here is this: before the state can detain people for significant periods of time, it must accord them a fair judicial process,” Chief Justice Beverley McLachlin wrote in the ruling.

The three men who brought the case are likely to remain jailed or under strict parole because the court suspended its decision for a year to allow Parliament to introduce a law consistent with the ruling.

The decision reflected striking differences from the current legal climate in the United States. In the Military Commissions Act of 2006, Congress stripped the federal courts of authority to hear challenges, through petitions for writs of habeas corpus, to the open-ended confinement of foreign terrorism suspects at Guantánamo Bay, Cuba.

A federal appeals court in Washington upheld the constitutionality of that law this week, dismissing 13 cases brought on behalf of 63 Guantánamo detainees. Their lawyers said they would file an appeal with the Supreme Court. In two earlier decisions, the justices ruled in favor of Guantánamo detainees on statutory grounds but did not address the deeper constitutional issues that this case appears to present.

Not withstanding that, as a conservative Catholic, I happen to largely agree with you on homosexuality & the extremist gay/feminist agenda, you're plainly obsessed with it to the point of a zealotry which renders liberal-like immunity to facts, logic & even basic common sense in virtually all other areas.
Besides being rudely offensive to your nation's legitimate friends & allies, your ill-considered view is doubly insulting to the countless families with branches on both sides of the border.

Please, let's stop debating this. I don't actually know what you mean by 'side-stepping & dancing', because I stand by that remark. I'll say it again: "With friends like these, who needs enemies?" It's intended to be a chilling reminder of what Canada has become. I don't retreat - and will not retreat - from that assertion as long as Canada remains a test tube for the worst liberal nuttery available in the so-called civilized world.

But, perhaps what you thought was 'dancing' is the fact that I don't pile all Canadians in with the national problem. I was trying to be gracious to you as a conservative, but it's clear you don't count yourself worthy of that. Unfortunate, really.

I pride myself in being blunt about Canada's moral apostasy. If it offends good Canadians, then they are defending something they shouldn't. I'm from California and I strongly condemn alot of the liberal, idiotic stuff that happens there, though I'm acutely aware that even CA is not as liberal as Canada. Sorry if you're insulted. My intention is to insult Canadian liberalism, not Canadian conservatives. But if you're hoping I'll retract my truthful statements to make you feel better, forget about it.

It only seems that way because this is one of Canada's cardinal sins and I've used it as a point of reference. Canada is cruising at break-neck speed for Sodom and Gommorah - and it's a real shame.

It's insulting, offensive, self-righteous, holier-than-thou, single issue zealotry which intentionally ignores a host of well-documented factors plainly indicating the exact opposite of what you're claiming.
