I'd be a lot more worried about what's in the food they're serving than the cigarette smoke in the air.
One does NOT know if proper measures to ensure food safety are being utilized in the kitchen because patrons are not permitted there....thus the need for the rules/regs/laws/whathaveyou.
Why do so many people have such difficulty with this simple concept?
