U.S. Attorney: 'I Was Ordered to Resign'

Former U.S. Attorney John McKay said his resignation was ordered by the Bush administration without explanation seven months after he received a favorable job evaluation.

"I was ordered to resign as U.S. attorney on Dec. 7 by the Justice Department," McKay said Wednesday in a telephone interview from Washington, D.C. "I was given no explanation. I certainly was told of no performance issues."

McKay, who had led the Justice Department's Western Washington office, previously said only that he was resigning because it was time for him to move on.

His comments came one day after Deputy Attorney General Paul McNulty acknowledged to the Senate Judiciary Committee that the Justice Department had fired seven U.S. attorneys in the West in the past year, most of them for "performance-related" reasons he would not divulge.

McKay is one of 7 western US Attorneys who have left Justice in the past year, and coincides with increased federal presence in the form of I.C.E. in northern California.

Don't know what to make of this, but these positions serve at the pleasure of the president. McKay knew that going in. My guess is his resume proudly states (and rightfully so) that he was a US Attorney

The indisputable fact is that USAs serve at the pleasure of the President. They come and they go for lots of reasons. Of the USAs appointed in my class at the beginning of this Administration, more than half are now gone. Turnover is not unusual and it rarely causes a problem because even though the job of USA is extremely important, the greatest assets of any successful USA are the career men and women who serve as AUSAs, victim-witness coordinators, paralegals, legal assistants, and administrative personnel. Their experience and professionalism ensures smooth continuity as the USA job transitions from one person to another.

Traditionally, every president has doled out the U.S. Attorney positions to his hand picked appointees. Clinton did it, too. My problem with GWB is that he HASN'T scoured the Justice Department completely of the Clintonistas.

I believe President Bush is pretty loyal to those who work for them so these folks must have either done a poor job lately or did something that was not illegal but questionable.

If Patty Murray and 9th Circuit judges are sticking up for McKay, it doesn't speak well for him.
