The defense lawyers would have to argue that this office is under investigation for hiding evidence and other ethics charges in any jury case, wouldn't they. That would be no matter who from Nifong's office actually handles the prosecution. It would be legal malpractice not to make that argument. And I do not see how a judge could keep that information from a jury?
