The thing you have to give the Dems is that they pick SCOTUS judges who support their causes. Look who GOP Presidents have selected:

Eisenhower: Warren and Brennan

Nixon: Blackmum

Ford: Stevens

Reagan: O'Connor and Kennedy

Bush 41: Souter

Of course there were some good ones thrown in, but over 50% was crud.

Perhaps Bush43 had the best picks, but he had a GOP Senate until a few weeks ago.

Yeah, it's pretty damning that this court only has a couple of Dem justices, and yet still leans left.

And it comes from the sort of mushy, unprincipled thinking that we're seeing on FR on these threads these days.

we don't litmus test our picks. and that's OK, because the litmus test ones couldn't get confirmed anyway. so the best any republican president does, is screen and select based on judicial philosophy. it's all we've got.

If Rudy does run, I hope he speaks frankly about this issue. because that's his only chance to salvage any position amongst social conservative, a careful explanation about the true facts behind judicial picks. he has to be able to get up there and say "my personal beliefs on abortion, won't be litmus tested into my judicial appointments".
