The Libby Trial: Whose Memory Problems?

Lewis Libby, Vice President Dick Cheney’s former chief of staff who is on trial for perjury and obstruction of justice, claims he doesn’t remember, or mis-remembers, some of the conversations he had with reporters concerning the former CIA employee Valerie Plame Wilson. That, Libby says, accounts for the differences between his testimony about talks with journalists like Tim Russert and Matthew Cooper and the accounts of Russert and Cooper themselves.

Witnesses in the Libby trial borrow a page from Hillary with the "I don't recall" excuse when Libby lawyers nail them on differences in their stories. York states as a concluding paragraph to the article: "The Libby defense has pointed out holes in the memories of some important witnesses in this case. And each time his lawyers accomplish that, Libby’s bad-memory defense becomes a little more plausible."

It's a shame that Libby's defense team can't put Fitzgerald under oath on the witness stand and ask HIM if he 'remembers' exactly when it was that he learned it was RICHARD ARMITAGE at State who leaked Valerie Plame's name, and if he DID 'forget' that, is that why he continued to pursue a pointless investigation wasting millions of taxpayer dollars to basically indict the Vice President's chief of staff because he didn't 'remember' everything accurately that Fitzgerald THINKS he should have 'remembered'?

Gee, I wonder why MSNBCs Shuster doesnt "report" the cross of the gov witnesses???????

Some "reporter"! Its hilarious to hear Chrissy/Olby say, "David, what happened in court today?" And I listen, listen, listen, for him to speak about the cross examination, and it never ever comes.

Bozos like Fitzgerald, Grossman, and Grenier are driving this case even though their own pitiful memories and intellects can't compare to Scooter Libby's.

Grenier now claims to have induced new memories in his feeble mind by pondering why he felt vaguely "guilty" about whatever he said to Libby. I hope the defense attorneys pounced hard upon this point (it's not fully indicated here): how on earth can a "memory" be considered reliable when the witness concedes he did not "recall" it until he pondered (long after the fact) why he felt "guilty" about a certain conversation?

And now Grenier does not even testify to any specific "recovered memory" from this bogus process: he merely infers that he must have said something because he feels vaguely guilty about the conversation.

What putrid b.s.

It seems to me as if Mr. Greiner's "remembering" what he told Scooter Libby and when--based in part on newspaper timelines--was very convenient for Mr. Greiner (and Mssrs. Armitage and Powell who may have been working against the administration from inside the State Department!) By remembering he "mentioned" Plame worked in the Counterproliferation Unit which sent Wilson in early June 2003, Greiner fingered Libby...while unfingering himself and others.

I tried to watch hardball a little this afternoon....OMG, what a bunch of @%$&^s.....they kept saying that the white house was all POed because hardball was on top of the plame affair...they had shuster reporting on someone's testimony, Martin, who was saying the administration was taking all sorts of actions about the plame leak...I couldn't stand to listen long enough to make it out.

After reading York's article, I'm pretty optimistic about Libby getting an acquittal. His lawyers are doing all the right things, striking right at the heart of the witnesses credibility. If I were a juror, I'd be thinking, "Why is this guy on trial? NONE of these guys can remember exactly when things happened. The witnesses have changed their stories as much as, or more than, Libby."

I was surprised just how vague Grenier's testimony was; I can't believe Fitz actually thought he would be a credible witness on the perjury charge. Even if he did tell Libby about Plame, he admits it was in a very offhand and oblique manner; in fact, he can't remember exactly what he said. Now, why should Fitz, or the jury, expect Libby to have a better memory of this than Grenier? It is laughable.
