Not the point, the point is govt' forcing smoke free eateries. Govt control over private property/business. Should be up to the business owner.

Yes, it's nice. But the right of the property owner to determine what is or isn't allowed in his own establishment (as long as it's a legal activity) trump your and my desire to eat in a smoke-free environment. I could see a law requiring the establishment to have prominent signs warning of the smoking going on inside, but that's the extent of it.
