That was uncalled for. People who don't have facts on their side are often embarrased to be in the presence of those who DO, and wish those with the truth to leave them alone.

You are crazy on this one. It's about protecting the border. Do you think 11 and 12 years in prison is a good sentencing?? They should have been put on leave or fired.

The majority in this country want our borders defended. Not being able to fire a gun at a drug smuggler will have devastating effects.

If the illegal had shot 15 times at a border agent, and hit them once, the illegal would be in jail for as long as these guys.

On the other hand, it is rational to punish police who break the law more harshly than average citizens, because the harm to society of the law enforcers being law breakers is much greater than criminals being lawbreakers.

As to the Jurors, it's hard to say. They get correct directions from the judge, and who knows how they are manipulated in the back room. I do tend to discount it, especially since I think the sentence is too severe, and I bet they agree.

I dislike federal sentencing guidelines. Jurors probably didn't think they'd go to jail that long for simply shooting a criminal in the butt.

Still, they did vote 12-0 for 14 of the 15 charges (one they aquitted, so it does appear they knew HOW to vote against a charge).

Even if now a couple are not so happy, that's still 10 who, having seen all the facts, are comfortable sending these guys to jail.

The border is a war zone; what they did was laudable, and they should have been honored for their quick action.

Typically, LEOs get the benefit of the doubt, I gess just not in the border zone.

Obviously some feel so strongly that what they did was so injurious that they had to be punished and made examples of.

We can argue nuances all day. I missed the earlier threads you referred to, I'm glad I did.

After Hamdiniya and Haditha, my stomach ain't what it used to be.

WHen they shot the guy, he was just an unarmed guy driving a van who ran away from them when pulled over. They didn't know he was illegal, didn't know what was in the van, and had no evidence he had committed a crime.

Assuming most agents are familiar with repeat offenders, and knowing the illegal WAS a repeat offender, brings me to the conclusion that they DID know what he was up to

They did make a mistake, a felonious one.
That felony carries a mandatory jail sentence.


How many pounds of marijuana does one have to transport into the US -- twice -- for that to be a felony?

Apparently, more than 800 pounds, because that drug dealer got immunity from prosecution. Mike Nifong couldn't have offered him a better deal.

I don't want to get into it with anybody but can you please(very politely) give me a heads up on this. I have no idea what is going on with these two BP agents. Another question and only a question not a personal attack but where do you stand on the idea of immigration both legal and illegal?

According to them (and I'd beliewve our Border Patol agents over an illegal alien drug smuggler), they did know he was illegal and they heard what sounded like shots. He was told to stop more than once and did not do so.

I'm so tired of you open borders people supporting anythign that is put out by the reconquista lobby.

Many in Congress are lazy and don't understand the facts of this case. Many democrats hate authority and would rather side with a drug smuggler who's testimony was relied upon and shouldn't be. The government's case was built in part on the testimony of a drug smuggler and gave him immunity. Watch he will win $5 million dollars of your and my money. And you will think he is right...give me a break.
