What would be the advantage of waiting for the dems to take this program to a friendly court. Then have to depend on the USSC for final approval.

yes, that's exactly how the system is supposed to work. one branch takes a position, the other branches have the ability to check and balance it. somebody wins, somebody loses.

From what I'm reading....you certain individuals are happy with politics entering the WOT...for 6 years...Bush didn't let politics interfere...he let the Dems rant and rave and did what he thought was right....so he gave up the surveillance program...so he could gain support for the increase in troops??...politics are/will kill us....and not figuratively...
