Court Allows Suit Against Air America Tuesday January 2, 5:24 pm ET Bankruptcy Court Allows Lawsuit Against Air America to Proceed
WASHINGTON (AP) -- Government contractor CACI International Inc. has won bankruptcy court approval to proceed with its defamation lawsuit against liberal talk radio network Air America and one of its hosts, Randi Rhodes.
A federal bankruptcy court in New York ruled Thursday that the case could proceed despite the fact that Air America has filed for Chapter 11 bankruptcy protection. Under federal law, legal proceedings against a company are frozen when the company declares bankruptcy.
CACI International asked the bankruptcy court in November to allow its case to go forward, arguing that its claims against Air America are covered by an insurance policy and any damages would be paid out of that policy and not from the company's assets.
The company sued Air America and its parent company, Piquant LLC, as well as Rhodes in the fall of 2005 for defamation. The suit stemmed from comments Rhodes made Aug. 25-26, 2005 on her radio show. According to CACI's complaint, she accused CACI employees of raping and murdering Iraqi civilians at Abu Ghraib prison, claims that CACI said were "false and defamatory."
CACI is seeking $1 million in compensatory damages and $10 million in punitive damages. An Air America spokeswoman declined to comment on the lawsuit.
A U.S. District Court dismissed the case, but CACI appealed that ruling. The bankruptcy court's decision allows the appeal to proceed.

I've listened to her occationally when she worked exclusively in West Palm Beach. She is so liberal and anti U.S. military and anti male it isn't even funny.

The burden of proof is now on the radio personality and her radio station.
HOWEVER I bet the insurance company settles and the radio personality has difficulty obtaining insurance after this.
Ms. Rhodes is socialist - who takes a paycheck(or used to take a paycheck, it would seem).
I've know a lot of folks at CACI. They're good troops.

I too heard the great entertainment value in RR's program when it was on the air in Dallas.
I loved her whacky, nutty, and unhinged point of view as it never ceased providing laughs. The moonbat callers are so crazy too that it was a nice break whenever I was in need of a chuckle.
That was before the Christian station bought the Airhead America station and starting blasting scripture at the unsuspecting DUmmies.
Though I no longer have my laughs, the idea of Dems. losing to religious programming is poetic justice.

Yep, I spent a little time with some English ladies during my time in the service. A friend had the misfortune of being named Randy. The ladies loved to tease him and of course he surmised the name was well deserved.
