I suppose you can say yes in a technical sense, that it is understood the prior leader of the caucus or conference, upon receiving majority status will thereby become Speaker, but it's by no means a foregone conclusion. The vote for speaker is held AFTER the swearing-in, and nothing to bar any member from either abstaining or voting for someone else, witness Mike Parker several years ago. There's nothing to keep a bunch of Dems from being so frustrated by the ranting antics of this dame, enough of them jump ship and vote for Hastert. Oh sure, it won't happen, not this term at any rate ... but someday, one of these idiots is going to count chickens before they've hatched and really, truly look stupid come Opening Day. I'd like to think it anyway.

Although I completely cannot fathom how Pelosi has the power to "decide" not to seat the state certified winning candidate, but I would say that if she does such a thing she'd better consider consequences should Senator Johnson be unable to return.

It's in the Constitution, specifically in Art. 1 Section. 5.

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members, and a Majority of each shall constitute a Quorum to do Business

Of course it's gross misuse of that power, but the only appeal might be to the Supreme Court, and by rights, they should uphold it, leaving it to the voters to right the abuse, in two years, after we've lost a major city or three to her Friends of the ROP.

Well in some cases yes, but it woudl get rather awkward if they don't pass the defense supplemental, or the FY2008 Defense budget. We be up to our a$$es in Jihadies, and no military to fight them, except unpaid volunteers using existing supplies, and of course the Militia, who provide their own arms and ammunition.

One second thought, the Jihadies might not like the results of that either.

The Bob Michel wing returns to their rightful place in the House, not that they ever got far away from it. It took about 2 yrs. for them to realize they had no idea how to wield power and didn't have the desire or cajones to try. It's been downhill ever since and now they've come full circle to where they are most comfortable.

Who seats the new Democratic representatives who give Pelosi the majority? Could the outgoing Republicans not simply seat Buchanan before they seat any of the new Democrats, and while they still posess the majority?
