I did read in this morning's paper that Maliki is the one who actually issues the order to carry out the execution.

But he has no discretion not to issue that order. It's just a matter of when within the 30 days to do it.

And everyone seems to be in agreement that sooner would be better. We almost certainly won't know until after the fact. Saddam himself will probably only get a few hours notice.
