Bullets that go up must come down. One true story I read about had to do with a lady out puttering around in her garden one day. Suddenly she just fell down, dead. They weren't even sure at first why she died -- then they discovered a bullet in her head.
A man quite some distance away (too far away to be heard) had shot a firearm at a rabbit at the top of a hill and missed. He was held responsible for her death.
So yeah, if you want to be potentially liable for manslaughter, then go ahead and shoot guns in the air. Otherwise, firing directly into a tree or into a proper backstop should be okay.
Perhaps not, if it's loaded with blanks. Gas operated weapons require a blank firing adapter, as well as blanks. BFAs are available for AR-15/M-16, SKS, and AK-47 and clones thereof. Others too I'm sure.
