A U.S. federal judge has thrown out a lawsuit by an Iraq war veteran who claimed filmmaker Michael Moore used the veteran's image without permission in the anti-war documentary "Fahrenheit 9/11."
According to court papers, Judge Douglas Woodlock of U.S. District Court in Massachusetts dismissed the suit on Wednesday. It had sought $35 million in damages from Moore, as well as Miramax, which is owned by Walt Disney Co. and several other film companies.
The film showed Iraq war veteran Sgt. Peter Damon, who had lost his right arm near the shoulder and much of his left arm, lying in a hospital gurney at Walter Reed Army Medical Center in Maryland, saying that he feels pain but that pain-killers given him "take a lot of the edge" off of it.
The video clip was originally used by NBC Nightly News for a story about medical treatment for veterans. In Moore's film, it followed a statement by Democratic Rep. Jim McDermott (news, bio, voting record) of Washington that "they're leaving all kinds of veterans behind."
I didn't read the whole piece, but would bet it was a judge appointed by Carter or Clinton.

Perhaps, but I wouldn't bet any $ on it. I can remember Robert Bork back in the 1980's explaining how he ruled in favor of a defendant who had posted a picture of Reagan laughing and pointing next to a picture of some poor people. Sounds like a similar event here, an attempt to link two disassociated events. If Bork saw that as protected speech, maybe the trial judge in this case was using the same reasoning.

As vile as Michael Moore is, the soldier didn't have much of a case. But it's a good thing that he brought suit and got his side of the story out there.
But I was thinking the same thing, especially in Taxachuesetts. I would've lost that bet too. I figure great minds think alike..... :-)

Thanks- I know we all miss Ronny Reagan. We will never have another like him but we need someone at least *approaching* his stature. It's like John Wayne. There will never be another one like him.
