I believe the key is in the phrase "cruel and unusual." My interpretation of this is that you can make it as cruel as you want, as long as it's not unusual.

As a widespread procedure, lethal injection is neither cruel nor unusual. Judge Fogel got the 8th Amendment wrong by the way. Nowhere in the Constitution does it ban capital punishment; to the contrary, it takes its existence for granted.
