What do you think would have happened if all the Justices had been murdered? Obviously, nine new Justices would have been needed pronto, but with the politics involved, could that have happened?
There's not an absolute need to install nine ASAP. Since there's no fixed number in the Constitution and we've had fewer than nine in most of the country's history, we only really need to confirm just one strong conservative.
