How differently things would have been if Frist had used the nuclear/Constitutional option last year.

What Bush should do is turn this into farse. Line up about 20 good people willing to do this. Nominate a good conservative justice. Wait one week for the democrats to make fools of themselves and withdraw the nominee - democrats vetoed him. Bring up the next guy. Wait one week for the democratw to make fools of themselves........Repeat for 2 years.

Justice John Paul Stevens, who was the subject of retirement speculations shortly before the elections, is 86 years-old and battling significant health problems. Ruth Bader Ginsberg, another abortion advocate is 73 years-old and has her own health concerns.

Well, should one or both of these goodfellows go on to meet their maker, Bush might consider the following option:
Nominate the best constitutionalist available and when the RATs defeat him/her, leave the post vacant.

if we had used the nuclear option last year - we would have lost the ability to use the fillibuster next year, when we are the minority.

in the end - the gang of 14 got us Alito and Roberts, and we could not have done better with those two picks.

Very stupid of the RATS to try and make being pro-abortion such a prominent qualification, especially before there is a nomination. They will lose support if they try to force their litmus test on the President's nominees.

Hey Bush, nominate the most pro-life judge you can find that does not mind their life being put under a microscope. This media attention will take the heat off of any "investigation" they want to launch. This will cause considerable infighting as the House and Senate egos will not allow them to suffer someone else in the spot light.

Democrats could defeat the first one, but what about the second, or third SCOTUS nominee sent?! It's gonna look very unsightly to the public that they cannot confirm a nomiee. The Party in charge of congress will own the resulting mess, because the confirmation part of the process is up to congress.

It will greatly benefit Republicans if Bush sends judges for confirmation that the Dems will seek to shoot down.

Let 'em shoot the judges down, and then rub their noses in it like a puppy!

Just propose judges that stay out of the issue, and want to allow the voters of each state to decide abortion laws for themselves.

Sen. Patrick Leahy, a Vermont Democrat, told Newsday that Bush should nominate only "consensus" nominees.

There is no "consensus" on abortion. You are either for it or against it. And any so-called "middle ground" is immediately torpedoed by the far-left as a "slippery slope". By "consenus", Leahy means "agree with me".

I wonder how long Leahy plans on keeping the court down at 8 justices while they piddle, twiddle and resolve.

We will not get any judges. They will simply tie them up in Committee for two years while the Judiciary conducts show trials of Bush Appointees
