Wrong. Should there be a USSC vacancy, there are plenty of strict constructionists on the circuit courts, specifically including women and minorities, whom the RATS wouldn't dare not confirm. The media cannot hide a USSC filibuster or committee assault.

The circuit court confirmation process, however, is another matter entirely. We are exactly back to 2002, when the RATS successfully buried Bush appellate court appointments in committee.
