In the recent court case in Detroit that declared the NSA monitoring illegal (and later stayed by the full court I believe), one of the claims against the monitoring was that the media could be monitored.

They are just using anything they can no matter how flimsy to get Bush.
The congress cannot limit the powers of the executive...unless the pres is a republican. At least they can try. If creating a huge firestorm out of nothing works then they will do it.
I do not remember anything like this happening under clinton.
