Hey - Duke had every right to expel those students!

Not without some form of due process (at least an administrative hearing). Under which, the university would need to discuss the totality of the evidence - unless they want to be subject to a HUGE lawsuit later on.

On what basis could they be expelled? Being accused?

Now THAT's justice! /sarcasm

The moment charges are filed, they must suspend pending investigation and resolution. Those are the guidelines across the board. What they didn't have to do is chop wood and add it to the blaze.
