He makes this claim all over the internet as well as hear on FR frequently referring to his mailin in the terms of his "testimony", "presentation" etc.
The above thread is an interesting read to note how his characterization of his "Founder's Plan: has changed over the years from his original stand.
"In addition to the above, the Fair Tax makes no provision to raise essential revenue in the event of a national emergency, such as war, or to extinguish an annual deficit. Under the Founders original tax plan, which the author of this article supports, the power to lay and collect a "direct tax" was placed in Congress hands for such emergencies ..."
Overlooking the fact that Article I section 9 of the Consitutition already provides such power to lay direct taxes, (e.g. capitation and land taxes) limited by the rule of apportionment if Congress were to be so foolish as to lay them on the American electorate.
