"ALL IM's can be retrieved?" Yes, but there must be a court order to obtain them from the ISP servers. Unless someone is accused of breaking the law, there would be no need to acquire the IMs. Now if a person has an enemy, and that enemy wants to set them up, they could certainly keep a log of the conversations.
