Schwarzenegger vetoes California Dream Act

To the Members of the California State Senate:

I am returning Senate Bill 160 without my signature.

I applaud all young people who work hard, graduate high school and attend college.

Current law allows undocumented students who have attended a California high school for three years and graduate from a California high school to attend a state college and get a reduced “in state tuition rate” but not be eligible for public financial aid dollars. California has over 100,000 students here legally who apply annually for financial aid to attend college, and our state has limited funds available for this important purpose.

While I do not believe that undocumented children should be penalized for the acts of their parents, this bill would penalize students here legally by reducing the financial aid they rely on to allow them to go to college and pursue their dreams.

For this reason, I am unable to sign this bill.

Citizenship should be required for ANY public service paid for by taxpayers. Not satisfied with stealing an basic education for their kids (mostlhy in Spanish at that), illegals now want to steal a college education. Lovely.

Glad Ahhhnold terminated it.

Excellent!

This was the "financial aid to illegal immigrants" bill passed by the CA socialist Leftist Legislature and Arnold VETOED it!!!


I bet Angelides would sign it.

Not only would he sign it...he'd require the bill to be in Spanish.

I just looked.... unfortunately he signed SB 1534, which will allow local governments to give a variety of benefits to illegal aliens.

From the Legislative Counsel Analysis of SB 1534, Public benefits. (Senators Ortiz and Alarcon)

Federal law, Section 411 of the federal Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA), provides that certain persons are not eligible for defined state and local public benefits unless a state law is enacted subsequent to the effective date of the act, August 22, 1996, that affirmatively provides for that eligibility.

This bill would declare the intent of the Legislature to affirm the ability of counties, cities, and hospital districts, at their own discretion, to provide health care and other services to all residents. The bill would authorize any city, county, city and county, or hospital district to provide aid, including health care, to persons who, but for the above-referred to provision of the federal PRWORA, would meet the eligibility requirements for any program of that entity.

From the Senate Floor Analysis

PRWORA prohibits states and counties from providing free or discounted nonemergency health care to the undocumented, but authorizes states to provide additional public benefits to this population as follows:

A State may provide that an alien who is not lawfully present in the U.S. is eligible for any State or local public benefit for which such alien would otherwise be ineligible under subsection (a) [which excludes them] of this section only through the enactment of a State law after August 22, 1996 which affirmatively provides for such eligibility.

According to the author, this bill provides the reaffirmation allowed under federal law.

Ugh. Thanks for pointing that out. It's a full-time job keeping up on what laws the legislature here is trying to force down our throats, isn't it.

It would be more than a full time job. I just took note of a few that I noticed during the year and decided to check up on their resolution.

100% of the Sierra Club's top priority bills that made it to the Governor's desk were signed.

46% of the Chamber of Commerce "job killer" bills that hit his desk were signed.

The GLBT community also fared very well, despite losing on some highly publicized bills. 7 of 9 of the Equality Californias (EQCA) "sponsored" bills were signed.

The lefties are still winning.
