When she's actively offering it for sale, she cannot be raped. Kidnapped, extorted, robbed, falsely imprisoned, attacked, battered, beaten, etc., yes. Raped, no.

Plain and simple BULLS**T!!!! I just had a thought... Let's say you decide that you want to have sex with a prostitute, where it's legal, in a NV brothel. I would have to say that you could assume that sex is being offered in such a place, wouldn't you? Now, let's say that you select a woman, and go back to her room and begin negotiating a price... And you can't come to an agreement. Are you telling me that if you force her to have sex at that point, then it's not rape? From things I heard, if that sort of thing happened, it would be the last time you had sex, and quite possibly the last time you did anything: There are lots of places to lose a body in the NV desert.

But again, are you telling me that if you forced a woman under those circumstances to have sex with you, or to perform some sort of sexual act that she didn't want to do, that would not be rape?

Certainly, if it's nothing more than fellatio at gunpoint, your hypothetical prostitute has not been raped, IMHO.
