It would be nice if the Federal court could indict someone for treason, if possible using a case with the strongest Constitutional applicability (adhering to the enemy, giving them aid and comfort seems pretty clear to me), and let it go through the court system all the way to the Supremes.

If the first case did not go, then try someone else.

Section 6. The Senators and Representatives shall receive a compensation for their services, to be ascertained by law, and paid out of the treasury of the United States. They shall in all cases, except treason, felony and breach of the peace, be privileged from arrest during their attendance at the session of their respective Houses, and in going to and returning from the same; and for any speech or debate in either House, they shall not be questioned in any other place.


Section 3. Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

And she is clearly falling into the category of "giving aid and comfort to the enemy." When she took it upon herself to go to North Vietnam, spew their party line about how America was the aggressor and criminal, denied that the POW's held in Hanoi were mistreated and tortured. She gave aid and comfort to our enemies (at that time). As a result of her actions, POW treatment continued to worsen in violation of the Geneva Convention. And only God knows how many American servicemen died as a result of her actions, not to mention the 2 million Vietnamese who were killed after we pulled out of Vietnam, thanks to her publicity rousing up the leftists in this country and putting pressure on the Nixon Administration at that time.

Good points. At the bottom of the Fonda broadcasts page is posted the compete transcript of the Congressional hearings prompted by Fonda's broadcasts from North Vietnam, which were called "Hearings Regarding H.R. 16742: Restraints on Travel to Hostile Areas," held from Sept 19-25, 1972 by the Committee on Internal Security. The Committee clearly recognized the nature of Fonda's broadcasts, and considered legal remedies.

She wasn't prosecuted due to a failure of will on the part of the Nixon Administration, not a lack of evidence. The fact that the antiwar movement could put hundreds of thousands of screaming protestors on their doorstep was probably a factor...

Yes, she and Kerry, etc caused the war to be lost. We won every battle.

Below (filmed earlier this year at a Fonda Lovefest): part of a Fonda/TerroristSupporters DVD they are sending to the troops to discourage them from fighting. Same tactics. Different results if we keep on task.
