Habeas Corpus, does certainly apply to U.S. citizens (Jose Padilla, Johnny Taliban) wherever held by the U.S. government. I can accept that the courts have held that it applies to foreigners held on U. S. soil.

In war, it applies to neither. If the person is an enemy combatant, then the laws of war apply, not the civil law.

Even US citizens have been executed for spying during war, without a criminal trial.

US civil and criminal courts are simply too slow to be used in a time of war. The entire country could be left in a smoldering pile of rubble before the court's docket is clear for the trials of our enemies.

If true, there's no need to legislate it, now is there?

That said, I agree with Specter that these prisoners do have the right to appeal their confinement. The only limitations of this right in the Constitution are cases of rebellion or invasion and I don't think they apply. The Congress should address this by creating a special court that can hear evidence in secret and decide if they are being lawfully detained. Otherwise we're just going to see ongoing litigation in open court which is hurtful to the war effort.

The lawyer for the blind sheik convicted of plotting the bombing of the WTC in 93. She carried terror messages from him to his followers.

Supposed to be sentence shortly. She was convicted of breaking the law, admitted it proudly, and then whined that she needed cancer treatment so don't put me in jail.

My guess is that the whole story was bull and she was hoping to get out of the country.

The constitution allows for the suspension of habeas corpus in cases of civil war and invasion (in other words, when we are dealing with a war). Treating the terrorism problem like a law enforcement issue is a really, really bad idea.

I'll tell you why. This administration does not want a true conservative agenda to flourish - as the elites that own them don't want it. As I have said from the day of his 1st inaugural that there will not be a conservative SC when he leaves. These elites won't allow it nor will they secure the borders & deal with ILLEGALS.
