Never believe anything you read in the press. My suspicion is that there is a LOT more to this story. The reporter was just looking for an unusual angle.
Having just skimmed the opinion, apparently the court held that the parents were otherwise equally fit for custody, and that Mom and her fiance's smoking was the only difference.
No, the mother lost custody unfairly because the judge based his decision on the fact she smokes and the father doesn't.
I'm a woman that has always supported the rights of fathers in divorce/custody battles........this is not one of them.
why does this surprise you?......a few years ago, a young woman lost custody of her child to the father because she DARED to go to college, and the father pushed the fact that she couldn't be a full time mother, even though, HIS mother was going to be watching the child predominatly.....
