A federal judge handed a victory to the defense Thursday in the Valerie Plame case, siding with Vice President Dick Cheney's indicted former chief of staff in a fight over release of classified information. U.S. District Judge Reggie Walton decided that he won't impose strict standards sought by prosecutors who want to limit the amount of classified information used in the trial of defendant I. Lewis Libby.

My question is: why hasn't the judge just thrown the whole case out? But any win for Libby is a win for the right side.

I believe that Libby and friends do not want the case to be thrown out and they don't want a pardon by President Bush. The trial, hopefully, will have tons of dems and their operatives in one huge hissy fit.
Now more than just a glimmer of hope that Fitzgerald might be forced to drop his case against Libby. This decision offers a great face-saving excuse for Fitzgerald. Now Fitzgerald can claim successful prosecution is not possible under this ruling, hellsbells, he can even say, "while I'm certain Mr. Libby is guilty, this ruling prevents me from prosecuting the case".
No pardon; Libby is not guilty of anything. We need this to go forward so Fitzy can be completely discounted and shamed (if not jailed).

Why? You think the media is going to report that? Please. Fitzgerald, Armitage, Powel, Wilson, Plame and the media have already been exposed about as much as will be broadcast. In the mean time, this guys life is in turmoil and he's spending millions in legal fees. Pardon him and let him do the talk show circuit to renew the whole discussion.

Yep, same here. I am positive that at this point EVERYBODY (especially Fitz, Scooter, the judge) would love for this mess to go away.
You are still stuck on "old media". Forget about them. Those dinosaur scumbags are done - - they can't hide anymore, they can't spike stories anymore, and they can't spin the news beyond recognition anymore and get away with it. Those days are gone forever.

I assume this refers to the fact that Richard Armitage was the official who disclosed Plame's identity to Robert Novak. Unfortunately, that's not what Libby is charged with. The charges are perjury, obstruction of justice and lying to the FBI. As far as I know none of that had anything to do with the Novak story, so I wouldn't hold my breath.
People reading the new media already know the truth. All that's left is to inform the remaining people in the country and they are reached by the old media.
The only reason to continue this farce is to get them to admit the truth and that's not worth letting Libby spend millions and twist in the wind. Besides, the pardon and the resulting Libby media tour would get more coverage than any trial results. Libby being acquitted would hardly be covered.
I would hold out for nothing less than complete exoneration and a good part of the defense bill picked up by Wilson via the civil suit.
You'll know this is really going down the tubes when indignant Dems start calling for Bush to pardon Libby and put and end to his travails. LOL
