But there weren't thousands of him doing stuff like that, and probably he hadn't pissed off the local cops much. The Rainbow folks tend to think of their gatherings as "home" but the the local towns and cities, these people are like an alien invasion.

Suppose your son and a few thousand buddies had just rolled into town and started picking up things... it's a different picture.

Still, it doesn't justify 6 months in jail. A couple of days would be more like it.

Why isn't this produce first being offered to a "soup kitchen" instead of being tossed? Bruised fruit may be unsellable, but that doesn't mean it is inedible.

Potential lawsuits. Another thing to thank lawyers for.

well the dumpster was on some ones else property so i can see the trespassing but the felony is stupid cause once it goes in the dumpster u have thrown it away and its not yours anymore....thats my view

Sounds more like these two were outsiders and the locals were going to throw the book at them. The whole idea of six months is so over the top that it is ludicrous. And how can you have a felony for stealing rotten fruit?

I agree completely -- I am appalled at the sentence, and the risk these guys will have in prison. My comments are only that I can explain the City's over-reaction in terms of dealing with the Gathering. Not that I agree with the sentence.

Like I said elsewhere, I have friends who attend the Gatherings, and they're mellow to the point of flaky. They would not do well in prison. Probably these guys are about the same -- mellow peaceniks. They'll get chewed up, and that's not right.

There are probably worse places to do time than Steamboat Springs lockup, if they think "stealing" from dumpsters calls for imprisonment, obviously the cops don't have enough to do! Where the heck was this guy's lawyer, anyhow?

Probably the worst horror will be missing most of ski season;)

I sincerely hope not, because they don't deserve that.

Thing is, the people I've known who attended Gatherings are not going to do well in jail. They're fundamentally NOT criminals, they're mostly lazy hippies (as noted elsewhere, nothing against hippies per se) with cosmic notions and stars in their eyes and bags of pot for sale.

Prison time will only serve to make them sad, and cynical. That's no improvement at all.

No - if they shot a racoon they would have been sent to a mental hospital with no trial for a complete mental examination. For that law, you may thank the animals are better than humans aspca.

Send those cops to San Francisco. They could arrest at least 20,000 "homeless" bums who are really into Dumpster Dining!

The same guys (who get homeless money from the city) are out there every day.

Sorry... I wrote about the risk before receiving your first comment, and I've calmed down. Consider my comment about the risk largely inoperative. ;-)

Nevertheless, the length of the sentence is out of line. I understand the City's concern, and their interest in making an example of these guys, but a couple nights in the clink would have served the purpose just as well.

Here's the thing in a nutshell:

Don Wirtshafter, an attorney in Ohio who represented many Rainbow Family members over the summer, said Charle and Siller were forced to choose between two evils.

Mr. Green never makes an appearance in their cases. They get Wirtshafted, and the Rainbowese are too stupid, or too poor..or both...to do anything about it.

Im my state, larceny of property under $250 is a misdemeanor; trespass is a misdemeanor; trespass to commit a misdemeanor is , yes, a misdemeanor!

I'm troubled more by the abuse of moral authority of the court, than by non-ethnic, retarded ecogypsies. (Are these guys Al Gore's base?)
