Starr, of the Los Angeles-based firm Kirkland & Ellis, filed the petition in the U.S. Supreme Court to challenge the March 10 decision by the 9th Circuit Court, which ruled that former Juneau-Douglas High School principal Deborah Morse violated former student Joseph Frederick's free speech rights.

Starr, the former independent counsel whose investigation led to the impeachment of former President Bill Clinton, has taken on the case pro bono for Morse and the school district. ......

He held up a sign that said "BONG HITS FOR JESUS" that was broadcast by TV coverage, IIRC.

Hell has frozen over, because I agree with the 9th Circuit Court of Appeals.

The appeals court said the banner was protected speech because it did not disrupt school activity and was displayed off school grounds during a non-curricular activity.

"Public schools are instrumentalities of government, and government is not entitled to suppress speech that undermines whatever missions it defines for itself," Judge Andrew Kleinfeld wrote in the court's opinion.

An obvious decision. Public schools have absolutely no business attempting to regulate the off-school-grounds behavior of students. The increasing tendency of them to do so is a gross example of big government overreaching.
