I'd say that using the government to put people in jail for smoking pot (especially since the laws were originally enacted to control the black population) - is, pretty much THE textbook example of Fascism.

You just stepped off the planet my friend. The laws on MJ were not passed to keep blacks in line ~ they used other laws for that purpose, and quite successfully too ~ right up to WWII and then they needed men to serve in the military.
