A federal district judge in Detroit has ruled that the Bush administration's NSA surveillance of phone conversations is unconstitutional.

on dkos, I found out that the appeals court with the jurisdiction in Michigan is the 6th.

Glancing through the list of judges I see that 6 out of 9, including chief, of the senior judges are GOP appointed. Also out of the regular judges 7 out of 13 are also GOP appointed. So, this seems to be an increasingly conservative court (a lot of new Bush appointed judges).

Kirpans. That rings a bell. I don't doubt that there were such cases - how did they turn out? I'm guessing by your earlier comment that they were legitimate religious symbols?

One other thing though, Sikhs are from India - - maybe not appropriate to refer to them as from the "middle east"? Pretty good friends with us in the WoT as I recall as well.

I guess if the ACLU thinks burning the flag is free speech, then they would think blowing up airplanes and taking down skyscrapers could be considered a form of speech as well.

You already have conflicting rulings between the FISA courts and now this other court.

It's bound for the Supreme Court eventually.

That's how the system works and that's how the battle will be won.

this on the heels of finding out that the recent plot in Britain was foiled in part due to listening to phone conversations between Pakistan and the UK

9/11 wasn't foild even with intercepted phone calls. I didn't know that the UK has the same Constitution that we have. What's your point?
