I would like to ask Mr. Brennan (and those who think like him) a few things:
  1. Are there any parts of the Constitution whose meaning should be considered to be fixed for all time, rather than adaptable to fit modern circumstances?
  2. If so, how may the "adaptable" parts be distinguished from the "fixed" parts?
  3. What rules should be used in determining whether a part of the Constitution should be interpreted as meaning what it says, or as what would seem more useful under present circumstances?
I wonder what such people would say?
