She should've sought help, as was her responsibility to herself and to society. I would've voted guilty. She DID seek help. They threw her out when her insurance ran out and Rusty did nothing. The doc actually could have gotten her state care and he had better things to do. It was the system that failed her when she asked for help and they didn't want to give it to her. That's a big thing that changed my mind about this case - here she was, sicker than a dog, asking for help, and that doc didn't want to work with a public-funds case. He ought to have his license yanked since he abandoned a patient over the issue of money despite Andrea's own pleadings. Scumbag. Just as guilty as Rusty. And that evil creature who gave false TV-show testimony in an earlier trial. And the dirtbag prosecutor with his political ambitions. To heck with them all, I hope all their careers are in ruins. They certainly had a good time abandoning Andrea for their own selfish reasons even as she pleaded for help.

Where are you getting the false information that Andrea Yates was NOT being treated because her insurance ran out? That's total BS.

Her psycho Medications had been adjusted a couple of days before she drowned her five children.

Yes, you have described the issue of "abandonment" by a physician quite well. In Minnesota, and I presume in Texas, your responsibility to the patient does not depend on being paid. This is especially true if this occurs in the middle of treatment.

This is a civil suit waiting to happen. Most likely, depending on the doctor's records it will be solved before trial. The presenting issue will be whether the doctor took state of the art steps to insure his patient had the necessary care and whether the family and the patient were aware of these and cooperated to the same

Further, a hospital can make a reasonable effort to find a different place for a non-paying patient, but, again, they are not off the hook either.

I must say most physicians and hospital personnel are unaware of their true, legal and moral responsibility; hence, they are often sued for dereliction of duty or "abandonment" depending on state statutes.

What did the prosecutor have to do with her killing her children?...

Rusty was never convicted of anything and thus not guilty just like the self admitted killer....

I was beginning to think you were as nuts as Andrea, but this post I actually sort of agree with. Nevertheless, she killed her kids in a calculating way and should have been found guilty for it. David Berkowitz, the "Son of Sam" killer, claimed that his neighbor's dog told him to do murder, but he still went up the river.

Andrea's seeking "help" may have been part of her plan all along. Society can't excuse multiple murder because the perpetrator went to a shrink before they committed the crime.
