That is true, but I would say it is the best objective criteria. I think it's pretty hard to call someone a RINO who votes the conservative way more then 80% of the time.
RINO means "Republican in name ONLY." It doesn't mean the guy just isn't Jesse Helms.

Chafee equals RINO. Alexander does not equal RINO. Corker will not equal RINO, although I agree that Bryant would make a better Senator.
But it won't matter for you. Anybody who doesn't agree with you is a RINO SELLOUT, right?
