Kin of boy who died in car trunk file lawsuits (how about taking responsibility for your kids?)

The parents of a Camden boy who died in the trunk of a parked car.....have filed a lawsuit against local officials and Toyota........David Agosto and his wife, Iraidia Roman-Santiago, are the second and third filed in the aftermath of the June 2005 tragedy. The three boys, Daniel Agosto, 6; Anibal Cruz, 11; and Jesstin Pagan, 5, disappeared from Cruz's backyard on June 20, 2005, setting off a massive search......About 48 hours after they disappeared, relatives looking for jumper cables found their bodies in the back of a broken-down Toyota Camry parked in the Cruz family's yard.

David Agosto opened the trunk and was one of the first to see the boys' bodies. He said yesterday it never occurred to him during the search that they might be so close. The police would have looked there already, he thought. "They had it under control," he said. Agosto, 40, initially said he did not want to take legal action.....But as he heard about problems with the search, Agosto changed his mind. "We can't fold our hands," he said, and let problems like this continue.

In her lawsuit, filed on behalf of her son and his two sisters, Roman-Santiago asserts that Toyota should be blamed, in part, for the deaths, because the company did not encourage owners of its cars to install a safety release inside the trunks. Under federal law, cars manufactured beginning with the 2002 model year must have the releases...............the suits blame Camden police for not checking the trunk sooner. Cruz's suit also blames several other government and police officials.

So these dumbos never thought to look in the car trunk and now they want everyone else to pay for their negligence.

One can hardly blame the police for assuming that the family loooked for the kids on their own property before calling 911 to report the kids missing.

From now on, Camden police will be forced to waste precious minutes searching the homes of missing children because parents are apparently incapable of looking in their own backyards.

My 2003 car has a brightly colored pull handle that opens the trunk from inside,even though *my* particular car doesn't have the traditional key opening on the trunk.

I'm sure that that feature came directly from Nissan's legal dept with just such an incident in mind.

One can hardly blame the police for assuming that the family loooked for the kids on their own property before calling 911 to report the kids missing.

Just the other day,they had a thing on the tube in Boston telling the story of a kid who,during the Blizzard of '78,went out to play in the snow and never came home. A couple of days later,after a massive search,they found the kid buried in a snowbank about 6 feet from his front door.

It's made of that "dayglo" kind of plastic..the type that you might think would be visible in very low light. Never having been in a car's trunk before,I don't know if it gets 100% dark inside of one,however.

even if the release was there, those young children may not nave known to pull it, my guess is the children were already unconscious or dead when the parents realized they were missing, thus, the parents have no lawsuit.

If one of my sons was missing, no amount of police searching or anyone else searching would ever be enough. I'd have to be searching, looking, praying, every minute.
I'm sorry, i know what you all are going to say. "illegal immigration in every thread" but these people ....i just feel it all over that they are illegal immigrants and they sat on their hands instead of both raising their children with wisdom and care and also instead of watching them and searching for them, just relied on others, now they want MONEEEEEEEY. Give me moneeeey Senor!
Maybe I'm doing them a disservice, I don't know, but they appear to be just stupid nincompoops. If you're that dumb, maybe we should take the rest of your children, before they get hurt too! Stupid useLESS idiots that are probably here illegally.

I hear what you are saying. I have no problem when people bring up illegal immigration when and where they want to.

I agree that these parents were not responsible and probably should have people looking into how they are taking care of their other children. I wish this case would be thrown out of court and them made to pay all court costs, etc.....but that probably won't happen. My heart breaks for what those children went through before they died.

They left out the part about the 842 repeat calls from Ambulance-Chasers that finally got him to file the suit with a 50% contingecy fee........

They (the "kin")ought to sue the parents for ignorance and child neglect, and move on.......

It's sad to say but little Jessica Lundsford was grabbed, raped and killed by the guy across the street, and was kept there while the search for her commenced.

I just checked.......my refrigerator interior has no release handle on the inside in case I get trapped chasing that last can of beer way at the back....

I gotta make sure to tell the wife to sue the crap out of Sears when I get caught in there and suffocate one day.
