These are NOT stray cats and are not preying on the wildlife ... most of it is bigger than they are. our cat was poisoned and almost died ... he stays in most of the time and just happened to get out one night ... anyway I think you're arguing just to argue ...

I now suspect that you're making this up! From your own posting supposedly from the DA:

"596. Every person who, without the consent of the owner, willfully administers poison to any animal, the property of another, or exposes any poisonous substance, with the intent that the same shall be taken or swallowed by any such animal, is guilty of a misdemeanor.

Here's a similar case. Three counts charged; one plea bargain, two dismissed.

More on the above case. It reads similar to your situation. Different state (Washington) -- different laws, though.
