Yes. Good news and we have to assume the Supremes will hear the case.

But how much will we bet that the cross is allowed to stand on the vague grounds that it's been there for fifty years and any standing cross less than that has to go.

Or the cross is 29 feet high and any standing cross less than that height has got to go.

And yes I'm being sarcastic, but SCOTUS has so emanated into the penumbra that their doesn't seem to be any clear cut decisions.

A lower court judge had ordered the city of San Diego to remove the cross or be fined $5,000 a day.

What kind of reprobate would make such a ruling?

OK, question.

IF these daily fines were imposed, which of the many government agencies would get the money? Who in the goverment are the beneficiaries of this windfall profit (tax)? How would it have been spent? On education programs touting the evils of white crosses, or on the evils of patriotic war memorials?

In addition to the numerous legal steps the Thomas Moore Law Center is taking to prevent removal of the memorial cross by August 1st, the Law Center is also asking all Americans to join in the effort to urge President Bush to immediately use the federal powers of eminent domain to take the land on which the cross and memorial sit by signing a petition to the President contained on its website at: www.thomasmore.org

Wonder why the city/county doesn't stick a covenant-in-perpetuity on the paperwork and sell it to a private owner {A Trust, maybe?] for a Dollar?

A way around all of this is for a group to create "The Church of Atheism", complete with tax exempt status. Then promoting atheism would be promoting a religion.

I is preposterous state of affairs when one "person" can hold a city hostage. Paulson should be made to pay all expenses for the trial if the judgment is against him.

San Diego voters overwhelmingly approved a ballot proposition ..... But a California Superior Court judge found the proposition to be unconstitutional.

So one POS can buy a judge (also a POS) and can inflict their wishes on the the millions? Do I have this right?
