Is Patsy really this stupid? Or does he think we are?
If you bring the NYTimes up on charges, guess what? You have to have EVIDENCE, and that means TESTIMONY in PUBLIC that will reveal even more about these programs.
Even FDR did not prosecute the Chicago Tribune in 1942 after it revealed the MAGIC program, largely because to do so would have made public still MORE secrets.

If their hands are too full to prosecute illegal dissemination of classified data, they need to set some things down. Somebody in the administration needs to lose their clearance & go to jail. I'm not sure how the prosecution of a corporate entity (the NYT) would work.

With the Chicago Tribune, the reference to having broken the MAGIC code was part of one sentence.
Justice has all the evidence it needs that the NYT deliberately, knowingly and ILLEGALLY published classified information - all they have to do is bring a copy of the paper to court as Exhibit A.

But if Bush believes that, why hasn't his Justice Department been directed to investigate these crimes against the Espionage Act and acts of treason in a time of war? Pat's right. What's going on? Is Harriet Myers telling Bush to lay low and ride the storm? Bush needs to do something ... the next "leak" might sink his ship.

Pat doesn't know what's going on behind the scenes and neither does anyone else. Tony Snow implied to O'Reilly that the lawyers were looking into what could be done. Obviously the White House can't bring a case unless they know they can win, since all media guns will be aimed at the President for the duration of his term.

Had a discussion today with a couple of colleagues.........
Came up with a few questions................
1. Did anyone not know that the feds were snooping through the banking transactions of Americans? - Not "suspected terrorists" but average Americans? How many of US haven't a clue about the "$10,000" reporting threshold? Even car dealers are compelled to report any cash transaction over $10k.
2. Did anyone not know that the feds have been monitoring telephone, fax, and e-mail correspondence? This has been widely reported since the clinton administration. Seriously, does anyone really believe that their conversations are private?
3. Did anyone really, seriously think that these "stories" were new or news?
I had my own opinions to share, but perhaps the questions themselves were more important? I don't know.
There is one thing I do KNOW, I loose more trust each and every day in our elected representatives and our "objective media" to act in the best interests of ALL Americans.

If the Administration prosecutes, the NY Times will clamor that this is a dictatorial, secretive Administration that is trying to spy on people and take away their freedom and privacy and abolish the freedom of the press. They will try to redirect the issue.
On the other hand, Bush doesn't appear to be one to duck a fight - he just picks his battles. I'm hoping that from now until the November elections the Administration will try to gain as much political traction as they can from what happened and then - particularly if they hold on to Congress - they'll pursue the issue legally. Hope.
