It would have been a lot easier if he had been shot while resisting arrest. That should happen also to those terrorist rather than being shipped to Gitmo. I would not be surprised at all if this was the ultimate result of the Hamdan case. And I'm OK with that...

I heard a former soldier in Iraq comfirm this yesterday. He said he would not subject his men to danger to capture these people only to have them go to a US court and freed.
