A commentator on CNBC (I think from the Wall Street Journal) made an interesting point that this could actually be bad news for the democrats because now they are going to sent the tribunal question to Congress and the Dems don't want to appear soft on National Defense right before the upcoming elections so the Dems are boxed in. Do they go against Bush and protect al qaeda - alienating the voters or do they give Bush a victory?

Just predicted this on another thread: this will NATIONALIZE the 2006 election in a way no one had foreseen. I may change my prediction of a GOP net gain of one seat in the Senate and five in the House to three in the Senate and 10 in the House.

True, and Rs in Congress could very quickly defuse the whole issue by passing legislation that explicitly affirms the right of the administration to use military tribunals for all scumbags at Guantanamo. Intelligent legislation rapidly moved through would put the Demagogues right back on the defensive and uphold the obvious rational national interest. This should not have been necessary under Article II of the US Constitution and with past wartime precedents for military tribunals. It is an inappropriate dilution and restriction for executive authority to have to go to Congress on this issue. Also, with milquetoasts like Arlen SPECTRE and other RINOs around, I hope that the legislation does not get all fouled up in the Senate Judiciary Committee, etc. Hoping that the R. leadership finally has the 'nads to do the right thing, and quickly!!

I think you're totally right. (re this being bad for Democrats in Congress really) This is really a BIG thing for conservatives because NOW Democrats will have to go on record with this, and most Americans are NOT impressed with this ruling, and do NOT want these terrorists tried in American courts. The clear majority of Republicans are on the same page on this, and a significant minority of "independents" and Democrats are in opposition to the liberals on this, so that spells a bad tasting issue for Congressional Democrats. For this to go bad, many Democrats in red States would have to fight vocally and go on the record against what MOST Americans want. That's political suicide and they may mouth off about it, but they won't vote against it and endanger their precious seats. This is a losing issue for Democrats just like partial birth abirtion, gay marriage, and saying the economy is bad. The fact that this now goes to Congress is GREAT! :)
