Is it a crime not to have your name on the package?
I've lost count of the number of times my physicians have given me samples of prescription drugs such as antibiotics or decongestants.
At no time were they labeled with my name.
When my doctor gave them to me the were, by definition, prescribed for me.
Different situation. The article makes reference to a "bottle" having been found. That suggests to me a standard Walgreen's type of prescription bottle. The article also says that the doctor's name was on the container and it was given to Rush. These references suggest to me that the doctor wrote a prescription to himself and then gave it to Rush "for privacy reasons".
Yes,doctors are allowed to give out samples of allergy medicines and other non-narcotic drugs. But it sounds to me as if the doctor could be in trouble for violations of state/Federal law and/or medical practice standards (that is,AMA rules)regulations.Rush could skate on this,IMO.
