It WAS a private plane and it is still subject to inspection by the Department of Homeland Security's Bureau of Customs and Border Protection.
ALL flights entering the US are subject to search and seizure. Since Rush is currently under adjudication for a drug related offense, his name is on a list of persons with drug offenses, making him more likely to be searched.
His adjudicated settlement states that ANY drug related offense of any type could potentially revoke his pre-plea agreement.
It was Bush administration bureaucrats from Homeland Security who turned Rush over to local law enforcement authorities; making it more likely that his detainment would become public knowledge.
