Couldn't happen in Florida.

actually... I know someone that happened to in clearwater. her husband got a 2nd mortgage without telling her... and yes, both on the deed, and then defaulted on the 2nd mortgage. lender pushed it into foreclosure and my friend was forced to leave her house. technically, the lender should never have given the loan with only one signature, but with a million dollar home, she didn't see to mind. the courts have been dragging their feet and she has lost all her savings trying to deal with it. by dragging their feet, i mean over 1 year. the husband has been ignoring the courts, and the courts don't seem to mind.

You're right. The law says she wins, but the courts don't necessarily follow the law.
