I see your reasoning but the USA did not train Iraq in the use of chemical weapons nor did we teach them how to make them. And even if the shells are pre 1991, the onus was on Saddam to declare all WMD to the UN inspectors. Obviously he did not and is in breach of his disarmament obligations as outlined in the 17 UNSCRs against Iraq.
