The federal/state govts routinely transfer and disposes of properties, often to special interest groups (as in the case of transferring many of the nation's lighthouses to private groups). this forced judicial fiat barring sale or transfer of this piece of property seems obviously instigated by hostility to the free exercise of religion (part 2 of the infamous "separation clause").
