Every time I see Goslee on tv I am both sickened and happy. Sickened that she was once a federal prosecutor and happy she is no longer one.

Well it turns out he is an associate prof, clearly with tenure not an assistant prof. BTW, associate prof for someone his age means Duke made an error, tenured him long ago and is stuck with him. He was not worth promoting to prof, but has tenure so they are stuck.

I agree Nifong's case is very weak, if it exists at all---which I doubt. Were I the trial judge, and based on what's public now, it is likely that I'd allow the prosecutor to present his case and then grant a motion to enter a judgment of acquittal on the basis that any reasonable jury could not fail to harbor a reasonable doubt. I am not aware of the extent of pretrial discovery in criminal cases in North Carolina. If it's like some states, discovery is pretty close to civil cases. If it's like the federal standard of trial by ambush, Nifong may be holding back something.
What do you mean by your 9th cir. comment? That's a mystery.

As for state prosecutors, I don't know if they can be sued or charged for such misconduct. There is no law of physics to prevent a university from packings its bags and moving to some other little southern town. THAT, or even the threat of it, would get the attention of the mayor and chamber of commerce of a place like Durham NC faster than you could blink.
