This sort of an incarceration is not lightly done by the military. These boys are involved in some bad sh*t.
Under certain circumstances, yes. The UCMJ has no provisions for bail. Suspects can be restricted or placed in the brig awaiting charges and trial. It's up to the local authorities, the serverity of the charges under consideration, etc.
The investigating officer is conducting what is, in UCMJ parlance, an Article 32 investigation yo determine first, if a crime has been committed and, second, if there is probable cause to believe the detained Marines are involved in it. The procedure is altogether proper and provided for in federal law as detailed in the Manual for Courts Martial applying the UCMJ (Uniform Code of Military Justice).

I'd rather see these men held on Paris Island and not in a compound on the West Coast controlled by "Marines" such as Congressman, former Marine Murtha.

It pisses me off as well, but in the eyes of the law they could be charged with murder which is why they are in preconfinment. I just can't believe that this whole situation is happening. I feel bad for them and the family. Hope everything will turn out good.
