It doesn't say the police have to knock once they have the warrant.

But the problem is judges give out warrants like candy anymore (with Prosecutors routinely hiding evidence that tells another side).

Let alone the number of (rightfully) dead cops we will see because of incorrect locations being raided via these "no-knock" searches.

We are becoming a police State more and more each year.

"Liberals" in the court rule governments can take your land and give it to someone else if they'll pay more taxes, "Conservatives" in the court say police can barge into your home. As they strip constitutional rights both point fingers of deflection to "legislatures."

Agreed (on the whole) - Where are becoming more and more a police State each year (but always for the common-good and our precious safety).

Never happen. It puts too much power in the wrong hands, and power, once put in the wrong hands, tends to stay there.

Exactly right - The police along with the courts love the WOD - It provides cash, toys and power for them year round. Though they are finding plenty of ways outside of the WOD to attain all three of these things as well.

What HELL is "Conservative" about another attack on our Fourth Amendment rights?

Why do so many here equate unlimited power for L.E. (and thus government) to be "conservative"?

It seems too many Americans have forgotten that our constitution was designed to limit Gov. Org. power in order to protect the rights of the citizenry.
This is the sort of garbage I saw coming thirty years ago, and figured prominently in my decision to never sire children.

My tag line remains unchanged, but reinforced.

Like any of that is adhered too!

Blank warrants, deliberately vague warrants, "plain sight", incidental to arrest, etc.

I feel SOOOO much safer now.

Nothing. This is a huge victory for the federal government. Its not a victory for conservatism as it further undermines our Constitutional rights.

Hah!

What is now common fare on TV is brain washing of the citizens to accept illicit searches as normal and acceptable!

Virtually ever L.E. based show now displays instances of L.E. circumventing the necessity of getting a warrant.
Windows are broken, then used a pretext for immediate entry, doors are stated to have been found ajar, blank warrants are produces, etc, etc, ad nauseam.
Naturally, since it is propaganda, in every instance the plot shows the unconstitutional entry to have been justified!

"The end justifies the means" in place of "To protect and serve".

Here is an interesting take by my better half.
Since there is no way to know if a search is valid:

Situation 1
The person who shoots the cop is the one being searched and valid exact evidence of crime in the warrant is found.
Murder - Cop Killer - Fry Their Ass

Situation 2
The person who shoots the cop and other stuff is found, stuff not in the warrant.
Innocent


Situation 3
Cops screw up and search the wrong place and a cop is killed.
Innocent


Situation 4
Criminals use the "right" technique and one is killed.
Innocent

Implication: Very very high level of danger in searches for both searcher and searchee.


Scary decision IMHO. Did they think it through. How to balance privacy (heh) right to bear arms, and search and seizure. Bad decision IMHO.

WOD is NOT the only reason for searches.

Not even close, perhaps not even the most common reason as it appears L.E. mostly ignores the drug trade.

Castle Doctrine, meet No-Knock Warrants.

The Castle Doctrine states you may use deadly force if you feel your life is threatened. And prosecutors may not charge you.

Then you have peace officers who are performing their lawful duty.

Quagmire, anyone?

They obtain a warrant through probable cause and they have to convince a judge that such a situation merits their searching the property.

If they suspect that you are armed, dangerous and a criminal then they are going to come at you hard.
