The Supreme Court does not have the right to declare a constitutional amendment unconstitutional. The only way to make a constitutional amendment unconstitutional is to repeal the former constitutional amendment.
Basically, the flag amendment repeals the "freedom of speech" part of the First Amendment. So according to these bureaucratic b*ttholes in Washington, freedom of speech is now unconstitutional.

Plus they would have legal precedent to declare burning the Mexican flag illegal (because this amendment basically codifies hate speech laws into federal law).
